Transferring Trademark Registrations to Amiga Corporation

In early August, Amiga Corporation and Hyperion Entertainment announced that an out-of-court settlement had been reached in their long-running legal dispute. Today I browsed and saw their news regarding that Hyperion has begun transferring trademark registrations to Amiga Corporation here.

Now the publicly available agreement shows what that means in practice — and the process has apparently already begun.

In the settlement filed as Case 2:18-cv-00381-RSM, Hyperion acknowledges, among other things, Amiga Corporation’s ownership of all relevant trademarks and agrees to abandon the trademark registrations it attempted during the dispute and to transfer any trademarks that may have already been registered to Amiga Corporation within 60 days.

That 60-day clock is running, and the first transfers are visible in trademark registers according to amiganews.de.

Transferred so far to the Amiga Corporation

According to EUIPO and national offices, the following trademarks previously held by Hyperion are now owned by Amiga Corporation:

  • EU: Workbench and AmigaOS
  • Benelux: Workbench, AmigaOS, Kickstart and AmigaOne
  • UK: Workbench and AmigaOS

The British trademark Amiga Forever has been returned to Cloanto, its original owner.

This matches exactly what was agreed in August: Commodore and Amiga trademarks remain with Amiga Corporation, while historical use (like keyboard symbols or old documentation) remains permitted.

Still with Hyperion — for now

A few registrations are still listed under Hyperion, but under the settlement they are to be abandoned or transferred:

  • France: Kickstart
  • Germany: Amiga
  • Italy: “Kickstart” (No. 302018000027648)
  • Poland: Kickstart
  • Spain: “Kickstart” (No. M3718535)
  • USA: AmigaOne
  • USA: AmigaOS

Once transferred, Amiga Corporation will hold a unified portfolio of Amiga trademarks again — first time since before 2009.

Why this matters for the Amiga Future?

For years, developers had to ask: who owns Workbench? Who can use Kickstart? Can I put AmigaOS on my box?

With the settlement, Amiga Corporation confirmed that Hyperion’s 68k engagement ends December 31, 2027 at the latest (or 16 months after OS 3.3 release). After that, Hyperion will hand over source code, revision history and documentation of AmigaOS 3.1.4 and all updates — minus any OS4-backported code — and release developers from Hyperion obligations.

Clear trademarks + clear code ownership + new RTG subsystem for AmigaOS 3 in development = one consistent AmigaOS 3 for original machines, emulators and new hardware.
